1. Agreement to Terms
By accessing, registering for, or using the Services provided by Transition Technologies Limited (UK Company No. 12992455) and its registered affiliate in Pakistan (“we,” “our,” “us”), you agree to be bound by these Terms of Service and all applicable laws and regulations.

2. Our Services
Hostingorphic provides domain name registration, web hosting, email hosting, and other related digital services. You acknowledge that domain name registration is subject to the policies and procedures of the relevant Internet Corporation for Assigned Names and Numbers (ICANN) and specific domain registries.

3. Account Registration
You must be at least 18 years of age to register an account. You agree to provide accurate and complete information and to keep this information updated. You are entirely responsible for maintaining the confidentiality of your password and account and for all activities that occur under your account.

4. Payments, Pricing, and Billing

• All fees for our Services are payable in advance.

• We reserve the right to change our prices at any time. Price changes will be effective upon posting to the Site and will apply to any subsequent renewals.

• Services are set to automatically renew on their expiry date to ensure uninterrupted service. It is your responsibility to cancel auto-renewal if you do not wish to continue the service.

• Accounts that are 10 days past due may be automatically suspended. Accounts 30 days past due may be terminated, and all data permanently deleted.

5. Acceptable Use Policy
You agree not to use, or allow others to use, our Services for:

• Illegal or Fraudulent Activity: Any activity that violates any applicable law or regulation.

• Unauthorized System Access: Attempting to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures.

• Spam: Sending unsolicited bulk commercial emails or engaging in any other spamming activities.

• Malicious Content: Hosting, distributing, or linking to malware, viruses, Trojan horses, or other destructive code.

• Infringing Content: Hosting or distributing content that infringes on the intellectual property rights of others.

• Phishing: Hosting phishing sites or engaging in identity theft.

• Resource Abuse: Consuming excessive server resources (CPU, memory, I/O) that impair the stability and performance of our shared hosting environment for other users.

We reserve the right to suspend or terminate your Services immediately, without prior notice or liability, for any violation of this Acceptable Use Policy.

6. User-Generated Content

• You retain all rights and responsibility for any content you upload, publish, display, or host on our servers (“Content”).

• You are solely responsible for securing and maintaining backups of your Content. We are not liable for any loss or corruption of your Content.

• We do not pre-screen Content but reserve the right (but have no obligation) to refuse or remove any Content that, in our sole discretion, violates any of our policies.

7. Third-Party Services
You acknowledge that certain Services, particularly domain name registration and third-party software (e.g., cPanel), are provided by third parties and are subject to their respective terms and conditions. We act as a reseller for these services and cannot be held liable for the actions, inactions, or policies of these third parties.

8. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will Transition Technologies Limited, its affiliates, officers, directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content.

Our total cumulative liability to you for any and all claims arising out of or relating to these Terms or the Services shall not exceed the greater of (a) £50 or (b) the total amount of fees received by us from you for the use of the Services during the twelve (12) month period prior to the event giving rise to the claim.

9. Indemnification
You agree to defend, indemnify, and hold harmless Transition Technologies Limited, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Service or your use of the Services.

10. Governing Law and Jurisdiction

• For Customers Principally Located in the United Kingdom or the European Economic Area (EEA): These Terms and any non-contractual obligations arising from them shall be governed by and construed in accordance with the laws of England and Wales. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

• For Customers Principally Located in Pakistan: These Terms and any non-contractual obligations arising from them shall be governed by and construed in accordance with the laws of Pakistan. You irrevocably agree that the courts of Karachi, Pakistan shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
